By accessing or using the Lumo Clean website (the “Site”) and purchasing any products or services from Lumo Clean, you (“customer” or “you”) agree to be bound by the following Terms and Conditions (“Terms”). These Terms apply to all orders, purchases, and use of our Site worldwide. If you do not agree with these Terms, you must not use the Site or purchase our products.

1. Products and Scope of Services

Lumo Clean (“Company”, “we”, “us”, or “our”) provides oral care and dental hygiene products, including but not limited to hands-free automatic toothbrushes, UV sanitizers, whitening strips, toothpaste, retainer cleaners, and related accessories (“Products”). We continually innovate and may introduce new Products or services (such as subscription plans) which will also be covered under these Terms. All information about our Products on the Site (including descriptions, specifications, and images) is as accurate as reasonably possible, but slight variations in appearance or packaging may occur. Such cosmetic differences do not affect Product functionality and are not grounds for cancellation or refund. By placing an order, you acknowledge and accept that you are purchasing a Product based on its core functionality and performance, not solely its aesthetics.

2. Acceptance of Terms and Account Use

By using our Site or placing an order, you confirm that you are at least 18 years old (or have reached the age of majority in your jurisdiction) or are using the Site under the supervision of a parent or legal guardian. You agree to provide current, complete, and accurate purchase and account information for all orders. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe you have violated these Terms or applicable law. We may amend these Terms from time to time, and will post the updated version on our Site. Continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms.

3. Product Use Disclaimer (No Medical or Dental Advice)

Our Products are designed for general oral hygiene and personal care. While we strive to provide high-quality products, we do not claim or guarantee any specific medical, dental, or therapeutic outcomes. Lumo Clean Products are not substitutes for professional dental care and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any information provided on our Site, packaging, or marketing materials is for informational purposes only and should not be construed as medical or dental advice. Always consult a dentist, doctor, or healthcare professional regarding questions about your oral health, especially if you have pre-existing dental or medical conditions. Use our Products only as directed and in accordance with provided instructions. Individual results will vary based on factors like personal hygiene habits, health status, and usage; therefore, we make no guarantee that any individual user will achieve the same results described in testimonials or marketing materials. All marketing claims (including any statements about whitening, plaque removal, gum health, or sterilization) are intended for general informational purposes, not as guarantees of performance.

4. No Guaranteed Results and User Testimonials

Lumo Clean makes no express or implied warranties regarding the efficacy or outcomes of using our Products. While many users report positive experiences, your personal results may differ. Any customer testimonials, reviews, before-and-after photos, influencer endorsements, or other user-generated content featured on our Site or social media are individual opinions and experiences – they do not constitute a promise or guarantee that you will achieve the same results.

5. Orders, Pricing, and Payment

All prices displayed on our Site are in Australian dollars (AUD) and include any applicable taxes (such as GST) unless stated otherwise. We reserve the right to change pricing or promotions for any Product at any time without notice. Promotional offers, discounts, or coupon codes are subject to their stated terms and may be modified or discontinued at our discretion. By placing an order, you are making an offer to purchase the selected Product(s) at the indicated price. Orders are subject to acceptance by us; we may cancel or refuse any order before it is processed, for example, due to suspected fraud, supply constraints, pricing errors, or other legitimate reasons. If we cancel an order after you have been charged, we will promptly issue a refund to the original payment method. You must provide valid payment details and you authorize us (or our third-party payment processor) to charge all sums due for your orders. We are not responsible for any additional fees (e.g. foreign transaction fees or currency conversion fees) your bank or card issuer may apply.

6. Shipping, Delivery, and Fulfillment

We ship products to customers globally. Any shipping times indicated at checkout or on our Site are estimates only; we do not guarantee specific delivery dates. Dispatch and transit times can vary based on product availability, your location, the shipping carrier, customs processing, and other factors. We will make reasonable efforts to process and dispatch orders promptly, but you acknowledge that delays can occur. Lumo Clean is not liable for delays or delivery failures caused by third-party carriers, international customs procedures, or any events beyond our reasonable control (e.g. logistics disruptions or natural events). Title to and risk of loss of the Products passes to you upon delivery to your address (or upon shipment, depending on the shipping terms, in accordance with applicable law). If a package is returned to us due to an incorrect address provided by you or because it was unclaimed, we may charge you for any reshipping fees or treat the order as cancelled. International customers are responsible for any import duties, taxes, or customs clearance fees that may apply to their orders; we have no control over these government-imposed charges and do not assume liability for them.

We partner with reputable third-party fulfillment centers and suppliers to store, package, and ship our Products in order to ensure global availability and timely delivery. Your order may be shipped directly by an authorized third-party logistics provider on our behalf (including shipments from warehouses outside your country). Regardless of the fulfillment source, all Products you receive will meet the advertised core specifications and functionality. Using third-party fulfillment does not diminish our responsibility to deliver the product you ordered, but it means packaging or origin may vary.

7. Returns, Refunds, and Exchanges

Change of Mind and Hygiene Policy: In general, all sales are final. We do not accept returns or exchanges for change of mind, dissatisfaction with cosmetic aspects, or unmet subjective expectations once a purchase is made. Due to health and hygiene considerations, any product that has been opened, unsealed, used, or otherwise taken out of its original sanitary packaging is strictly non-returnable and non-refundable (unless required under applicable consumer law). Products sealed for hygiene reasons can only be returned if the original seal remains completely intact (i.e., the product is unopened and unused). We reserve the right to reject any return if there is evidence the product has been used or if the seal/packaging is not intact upon receipt.

Discretionary 7-Day Return Window: As a courtesy (and subject to the above hygiene restrictions), we may at our sole discretion agree to accept a return of a Product if: (a) you contact us within 7 days of delivery to request a return authorization, and (b) the Product is unopened, unused, in its original packaging, and in brand new re-sellable condition. We are under no obligation to approve a change-of-mind return, but may do so in our discretion to enhance customer satisfaction. If we authorize a return, we will provide instructions for shipping the item back. You will be responsible for all return shipping costs (and we recommend using a trackable shipping service). The original shipping fee (if any) is non-refundable. Upon receiving and inspecting the returned item to confirm it meets the above conditions, we will issue either a refund to your original payment method or store credit or exchange, at our election. Any refund for a discretionary return may exclude a reasonable restocking fee or our original shipping costs.

Defective or Incorrect Products: In the unlikely event that you receive a product that is faulty, damaged in transit, or not what you ordered, please notify us as soon as possible (ideally within 48 hours of delivery) with details of the issue. We may request photographic or video evidence of the defect or error to assist our assessment. If we determine that the product was delivered in a defective or damaged condition, or a wrong item was sent, we will, at our option: (i) arrange a replacement or exchange at no additional cost to you, or (ii) provide you with a full refund of the purchase price (including any initial shipping fee). Depending on the situation, we may provide you a prepaid return label for the return of the defective/incorrect item, or we may instruct you that no return is necessary. Please do not dispose of or return any item until we have provided return instructions, as we may need the item returned to investigate or process a claim.

Statutory Rights: Nothing in these Terms excludes, restricts, or modifies any rights you may have under consumer protection laws that apply to your purchase, including the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. The above change-of-mind return policy does not apply (and no restocking fee or other charge will be withheld) where you are entitled by law to a remedy for a faulty product. Consumers in other jurisdictions may have similar rights under local laws. We will honor all such non-excludable legal guarantees and remedies as required by applicable law.

8. Subscription and Recurring Services

Lumo Clean may offer subscription programs or recurring service plans for certain Products (for example, periodic replacement brush heads or refills). If you enroll in a subscription or any auto-renewing service, you expressly agree that we (or our third-party payment processor) may charge your provided payment method on a recurring basis (e.g. monthly or annually, as offered) for the subscription fees, including any applicable taxes, without further authorization from you, until you cancel the subscription. The amount, frequency, and duration of the charges will be as selected or disclosed to you at the time you sign up. By proceeding with a subscription order, you are agreeing to the recurring payment terms displayed at checkout.

Cancellation of Subscription: You may cancel a subscription at any time, subject to any minimum commitment period disclosed for that offer. To cancel, follow the instructions provided on our Site (e.g. through your account settings) or contact our customer support. Cancellations will generally take effect at the end of the then-current billing period. You will not be entitled to a prorated refund for the remaining portion of a billing cycle unless stated otherwise in the specific offer or required by law. For example, if you cancel in the middle of a month for a monthly subscription, you may continue to receive the service or product until the end of that paid month, and the cancellation will prevent future charges going forward. We may, at our discretion, grant a refund for the unused portion of a prepaid subscription if you cancel and request a refund, but this is not guaranteed (except where required by law).

Changes to Subscription Terms: We reserve the right to adjust pricing for our subscription products or services. If the price of your subscription is due to change, we will give you reasonable advance notice via the email associated with your account or via the Site. If you do not agree to the new price, you must cancel the subscription before the new pricing takes effect. Continued participation in the subscription after the price change constitutes your acceptance of the new fees. We may also discontinue a subscription program or convert it to a different product or frequency by providing notice to you. If we discontinue your subscription, you will not be charged further and will receive a prorated refund for any period you have paid for in advance that will not be fulfilled.

9. User Conduct and Acceptable Use

You agree to use the Site and our services only for lawful purposes and in compliance with these Terms. You must not engage in any conduct that interferes with or disrupts the Site or that infringes on ours or any third party’s rights. By using our Site, you agree not to:

  • Violate any applicable local, state, national, or international law or regulation while using the Site or purchasing our Products.

  • Use the Site for any fraudulent or deceptive purpose, or to impersonate any person or entity.

  • Post, transmit, or otherwise make available any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, invasive of another’s privacy, hateful, or otherwise objectionable. This includes any content that is false or misleading, or that could damage the reputation of others or of Lumo Clean.

  • Upload, transmit, or distribute viruses, malware, or any other malicious code that could damage or interfere with the operation of the Site, our systems, or other users’ systems.

  • Attempt to gain unauthorized access to any portion or feature of the Site, any other systems or networks connected to the Site, or to any server, or to the services offered on or through the Site (e.g., by hacking, password “mining” or any other illegitimate means).

  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission, or take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Site or any software that is part of our services (except to the extent such activity is expressly permitted by applicable law).

  • Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Lumo Clean or users of the Site, or expose them to liability.

We reserve the right to monitor access to and use of our Site for compliance with these Terms. We may refuse service, terminate accounts, or take legal action against users who violate this User Conduct section or any other provision of these Terms. If you breach these Terms and we do not take immediate action, that does not mean we have waived any rights (see General Provisions below on No Waiver).

10. User-Generated Content and Reviews

Our Site or online platforms may allow customers to submit reviews, comments, photos, testimonials, or other content related to our Products or business (“User-Generated Content” or “UGC”). If you submit any UGC, you agree to the following terms:

  • Legitimate Content: You will only post content that is truthful and based on your actual experience with our Products or brand. You must not submit any content that is knowingly false, misleading, or fraudulent. Any claims you make in a review or comment should reflect your honest opinions.

  • Prohibited Content: You must not post or upload any content that is unlawful, defamatory, libelous, harassing, abusive, obscene, sexually explicit, discriminatory, or otherwise objectionable. Your content should not include others’ confidential or personal information (e.g. someone’s address or phone number) without permission, and should not violate any third party’s intellectual property or privacy rights. In particular, do not upload content (text, images, video, etc.) that you do not have the rights to use.

  • License to Use: By submitting UGC on our Site or tagging our brand on social media, you grant Lumo Clean a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit, publish, translate, distribute, publicly display, and otherwise exploit that content in any media. This license allows us, for example, to display your review on our website, use testimonials in our marketing, or share photos you tag us in. You retain ownership of your content; this license does not transfer ownership to us, but it gives us permission to use it without further compensation to you.

  • No Infringement: You represent and warrant that any content you post is your original work (or you have all necessary rights from the owner to post it) and that our use of your content will not infringe or violate the rights of any third party. This means you must not copy content from others or include any trademarks, logos, or copyrighted material of others in what you post (unless you have permission).

  • Moderation and Removal: We do not actively endorse or verify UGC posted by users, and such content does not reflect our opinions. However, we reserve the right (but not the obligation) to monitor, edit, refuse to publish, or remove any user content at our sole discretion. We may remove content that we determine violates these Terms or that is otherwise objectionable, without notice. We also reserve the right to suspend or terminate your account or ability to post content for any reason.

  • No Liability for UGC: You acknowledge that you are solely responsible for any content you submit and the consequences of sharing it publicly. Lumo Clean is not responsible or liable for any user-submitted content, including any errors, omissions, or harm resulting from such content. You agree to indemnify Lumo Clean for any claims arising from your content (see Indemnification below) if your content causes harm or legal liability to someone else.

If you believe another user’s content violates these Terms or your rights, you may report it to us using the contact information below. We will review such requests and take action as we deem appropriate.

11. Intellectual Property Rights

All content on the Lumo Clean Site – including text, descriptions, product names, images, graphics, logos, icons, videos, audio clips, designs, and software – is the property of Lumo Clean or our content suppliers and is protected by intellectual property laws. This includes the “Lumo Clean” brand name, logos, and all trademarks or service marks owned by us, whether registered or unregistered. You are granted a limited, revocable license to access and make personal, non-commercial use of our Site and content. No part of the Site or its content may be reproduced, distributed, modified, publicly displayed, uploaded, posted, or transmitted in any form or by any means without our prior written permission, except as allowed by law (such as fair dealing/fair use). You may not use any meta tags or other “hidden text” utilizing our name or trademarks without our express consent. All rights not expressly granted to you in these Terms are reserved by Lumo Clean and its licensors.

If you are a member of the press or an influencer and need images or content for editorial use, please contact us for appropriate assets and authorization. Unauthorized use of our intellectual property (including framing our Site or using any trademark as part of a link without permission) is strictly prohibited and may result in termination of the limited license granted to you, as well as legal action.

12. Third-Party Links and Services

Our Site or communications may contain links to third-party websites or services (for example, payment processors, social media pages, or partner promotions). These third-party sites and services are not owned or controlled by Lumo Clean, and we provide these links solely for your convenience or informational purposes. We do not endorse and are not responsible for the content, offerings, or availability of any third-party websites or resources. If you access any third-party website or engage with third-party services (including those that may be linked from our Site), you do so at your own risk. Different terms and privacy policies may apply to third-party services, and you should review those carefully. Lumo Clean is not liable for any loss or damage that may arise from your use of, or reliance on, any third-party sites or content.

Additionally, if we integrate or offer services from third parties (for example, a third-party payment gateway or an embedded content feed), such services are provided “as is” and we make no warranties regarding them. Any disputes or questions concerning a third-party service’s performance or terms should be directed to that third party. That said, please inform us if you experience an issue with any linked content or third-party service related to Lumo Clean, so we can consider whether any action is needed on our part (for instance, removing a problematic link).

13. Indemnification

You agree to indemnify, defend, and hold harmless Lumo Clean, its parent company, affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with (a) your use of the Site or Products other than as permitted by these Terms; (b) your breach or alleged breach of these Terms; or (c) your violation of any law or the rights of any third party. This means that if a third party makes a claim against us because of your actions, content, or information in connection with Lumo Clean, you will be responsible for any harm, loss, or cost that we incur as a result of that claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. This indemnity obligation will survive termination of your use of our services or Site.

14. Limitation of Liability and Disclaimers

To the maximum extent permitted by applicable law, Lumo Clean (including our officers, directors, employees, agents, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive losses or damages arising out of or in connection with your use of our Products or Site. This includes, without limitation, any loss of profits, loss of data, loss of goodwill, or the cost of substitute goods or services. We are not liable for any delay or failure in performance of our obligations that results from events beyond our reasonable control.

Except as expressly provided in these Terms, and to the fullest extent allowed by law, our Products and services are provided on an “as is” and “as available” basis, without any warranties, guarantees, or conditions of any kind, either express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any defects will be corrected.

In particular, Lumo Clean makes no warranty or representation that the use of our Products will result in any specific outcome for your dental or oral health. You assume full responsibility for the proper use of all Products and for following all usage instructions and safety guidelines. Any improper use of the Products, or use not in accordance with provided instructions, is at your own risk. We also do not guarantee the continuous availability of any Product or that any Product will remain available for purchase for any given period.

If, notwithstanding the foregoing disclaimers, Lumo Clean is found to be liable to you for any claim arising out of or related to these Terms or your use of our Products, our aggregate liability to you shall not exceed the amount you paid to us for the product or service in question, or AUD $100, whichever is greater. In jurisdictions that do not allow certain limitations of liability, our liability will be limited to the minimum extent permitted by law.

Consumer Law Notice: Nothing in this Limitation of Liability section is intended to exclude or restrict any rights or remedies you have under the Australian Consumer Law or other applicable consumer protection legislation that cannot legally be excluded. If you are a consumer, you may have certain legal rights that apply regardless of what these Terms state, and our liability is not excluded to the extent not permitted by law.

15. Product Safety and Usage Guidelines

You must use our Products responsibly and in accordance with the instructions provided. Our Products are intended for personal, domestic use only. They are not intended for use in professional settings or for any unlawful purpose. Keep Products out of the reach of children, except for those Products expressly designed and marketed for use by children under adult supervision (such as a children’s toothbrush). Even then, adult supervision is recommended to ensure safe use.

Do not attempt to disassemble, modify, or tamper with any Product; doing so may not only damage the item and void any warranty, but also pose safety risks. In particular, if a Product includes a UV light sanitizer or similar component, never look directly at an active UV light or expose skin to it outside of the product’s intended usage, as UV light can cause harm with improper exposure. If a Product requires charging, only use the charger or cable provided (or an appropriate replacement from us) and follow the charging instructions.

Failure to follow safety and usage guidelines may result in damage to the Product or injury to persons, for which Lumo Clean bears no responsibility. By using the Product, you agree that you will follow all user manuals, inserts, and instructions provided. If you have any questions about the safe operation of a Product, please contact us for guidance before use. In case of any adverse reaction (for example, gum irritation from a whitening product), discontinue use immediately and consult a healthcare professional if necessary.

16. Privacy

Your submission of personal information through the Site or in connection with purchases is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal data. By using our Site or ordering Products, you consent to the collection and use of information as described in our Privacy Policy. If any provision in these Terms is inconsistent with the provisions of the Privacy Policy regarding personal data, the Privacy Policy will prevail to the extent of the inconsistency.

17. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate your agreement with us at any time by ceasing to use our Site and services, and if you have an account, by deleting it or requesting that we delete it (subject to any surviving obligations for pending orders or subscriptions). Lumo Clean may terminate, suspend, or restrict your access to the Site or your ability to purchase, without notice or liability, if we believe that you have violated these Terms or any applicable law, or for any other reason in our sole discretion (including business or operational reasons). In the event of termination by us due to your breach, any outstanding orders may be canceled (with or without refund, at our discretion, depending on the circumstances of the breach). Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law) will survive.

18. Governing Law and Jurisdiction

These Terms and any separate agreements by which we provide you services or sell you products shall be governed by and construed in accordance with the laws of Australia. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of our Site or Products will be subject to the exclusive jurisdiction of the courts of Australia. If you are an Australian consumer, this typically means the courts of the state or territory in which you reside or in which our business is based. If you reside outside of Australia, you agree that any disputes shall be litigated in the appropriate courts of Australia, unless otherwise required by a law of your country of residence (in which case you may additionally retain the rights to bring an action in your local courts). We and you both consent to the personal jurisdiction of such courts and waive any objections (such as inconvenient forum) to the handling of disputes in those courts.

Please note that the Uniform Convention on Contracts for the International Sale of Goods (Vienna 1980) does not apply to transactions under these Terms.

19. General Provisions

Entire Agreement: These Terms (along with any other policies or legal notices expressly incorporated by reference, such as our Privacy Policy and any specific product warranty or promotion terms) constitute the entire agreement between you and Lumo Clean regarding your use of our Site and purchase of our Products. They supersede any prior or contemporaneous understandings, agreements, representations, or proposals, whether oral or written, between us and you (including any prior versions of the Terms).

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. An unenforceable section will be interpreted, replaced, or reformed to fulfill its intended purpose to the greatest extent permitted by law, and the validity and enforceability of other provisions will not be affected.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Lumo Clean. Similarly, a failure by you to exercise any right under these Terms or delay in enforcing any provision shall not constitute a waiver of that or any other provision.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our obligations and rights under these Terms to another entity (for example, in the event of a corporate reorganization or business transfer) by providing notice to you, and such assignment will not affect your rights or our obligations under these Terms.

Force Majeure: We will not be liable for any delay or failure in performance of any part of our services or delivery of Products to you to the extent such delay or failure is caused by an event or circumstance beyond our reasonable control, including but not limited to acts of God, war, pandemics, natural disasters, strikes, courier or supply chain disruptions, power outages, or governmental actions.

Relationship: Nothing in these Terms shall be construed to create a joint venture, partnership, employment, or agency relationship between you and Lumo Clean. We are an independent seller and you are purchasing products as a consumer (or, if applicable, as a business customer) – no fiduciary or special relationship exists between us by virtue of these Terms or your use of the Site.

Headings: Section titles and headings in these Terms are for convenience only and have no legal or contractual effect.

Language: These Terms are written in English. If they are translated into another language, the English text shall govern to the extent of any inconsistency.

Notices: Any notices or communications to be given under these Terms must be in writing. We may provide notices to you by e-mail to the address you provided or by posting on our Site. You may contact us as described in the Contact Information section below. Notices sent by email will be deemed received 24 hours after the email is sent, unless the sender is notified that the email address is invalid or the message was not delivered.
